According to Article 10 of the Decree n° 61-553 of October 12, 1961 fixing the attributions of the consuls of the Malagasy Republic:
“The functions of civil registrar are exercised, abroad, by the heads of diplomatic missions provided with a consular district and the heads of consular posts”.
According to Article 19 of Law No. 2018-027 of February 08, 2019 on civil status:
“Civil status facts concerning nationals of Malagasy nationality established abroad are declared to the diplomatic or consular post in whose jurisdiction they have established their habitual residence. The functions of the civil registrar are exercised, abroad, by the heads of diplomatic missions with a consular district and the heads of consular posts.”
From the above, the head of the Embassy in his capacity as a Civil Registrar exercises certain attributions of a Mayor whose missions are legislated by Law N°2014-020 of September 27, 2014 Relating to the resources of decentralized territorial Communities, the modalities of elections, as well as the organization, functioning and attributions of their bodies. The said law stipulates in its Article 49: “in official ceremonies, the Mayor and the Deputies wear, as a belt, a scarf in the national colors, white, red and green,…”

Important Recommendation

Passport holders must, if they settle abroad, register with the Consulate of the Republic of Madagascar within three months of their arrival in the consular district.
- Applicable legislation governing the personal law of any Malagasy national, notwithstanding their place of residence, remains the MALAGASY LAW.
Only the Malagasy law prevails in any question relating to the state civil.
